Privacy Policy

Clutch Advance (“we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what information we collect when you visit clutchadvance.com, apply for funding, or contact us, how we use and share that information, and the choices you have.

Effective October 17, 2026

Information we collect

We collect information you give us directly, information generated when you use our site, and information we receive from third parties in the course of processing a funding request.

  • Contact details — your name, email address, phone number, and business or mailing address.
  • Business information — legal business name, DBA, EIN/Tax ID, entity type, date established, industry, time in business, and business contact details.
  • Application details — the funding amount you request, your intended use of funds, average monthly card volume and gross sales, outstanding advances, owner details, trade references, and other information you provide in an application.
  • Documents — bank statements, a voided business check, government-issued photo identification, and any other documents you upload.
  • Information collected automatically — IP address, device and browser type, operating system, pages viewed, referring URL, and similar usage data collected through cookies and comparable technologies.
  • Information from third parties — credit and verification data, bank and card-processor verification, and fraud-prevention data obtained with your authorization.

How we use your information

We use the information we collect for the following purposes:

  • Processing applications — reviewing, underwriting, verifying, and making decisions on your funding request.
  • Servicing — funding your advance or loan, administering repayment, and managing your account.
  • Contacting you — responding to your inquiry and communicating with you by phone, text message, and email about your application and account.
  • Fraud prevention and security — verifying your identity and detecting, investigating, and preventing fraud and misuse.
  • Compliance — meeting our legal, regulatory, licensing, and recordkeeping obligations.
  • Improving our services — understanding how our site is used so we can make it better.

Calls and text messages (consent terms)

We call or text you only where you have given us your consent to do so. When you provide a phone number and check the optional consent box on one of our forms, you agree to receive customer-care and application-related calls and text messages from Clutch Advance only at the phone number you provide, including messages sent using automated technology.

Your consent runs to Clutch Advance only. No affiliate, funding partner, or service provider is a separate sender of our text messages or an opt-in beneficiary of your consent. Any service provider that supports our messaging, such as the platform that delivers our texts, acts on Clutch Advance's behalf and under our instructions.

Those messages may include responses to your inquiry, application-status updates, secure document-upload links, appointment reminders, and follow-up about a request you initiated. We do not use this consent to send promotional or marketing messages.

Consent is not a condition of approval, funding, or purchase. The consent box is optional — you are not required to check it, and you may submit an inquiry without it. Message and data rates may apply, and message frequency varies.

You can withdraw your consent at any time. Reply STOP to any text message to stop receiving texts, or reply HELP for help. To stop receiving calls, tell the representative on the call or contact us using the details below and we will add your number to our do-not-call list. Opting out does not prevent us from contacting you about an active application or account where the law permits or requires it.

How we share your information

We share information only as needed to provide our services and as required by law.

  • Funding partners — the lenders and funders that may provide your financing — and the service providers described below, who help us evaluate, underwrite, and fund your request. Information is shared only as needed to process your deal, and our service providers are not permitted to use it for their own marketing. They process it on Clutch Advance's behalf and under our instructions; they are not separate senders of our calls or text messages and do not receive your SMS consent as opt-in beneficiaries.
  • Service providers — vendors who support our operations, such as credit and verification services, identity and fraud-prevention providers, payment processors, hosting and analytics providers, and communication services.
  • Professional advisors — attorneys, auditors, and insurers.
  • Legal and regulatory — when required by law, subpoena, or regulation, or to protect the rights, property, or safety of Clutch Advance, our customers, or others.
  • Business transfers — in connection with a merger, acquisition, financing, or sale of assets.

We do not sell your personal information to third parties, and we do not share it with unaffiliated third parties for their own marketing purposes without your consent.

Data retention

We retain your information for as long as necessary to fulfill the purposes described in this policy, including to process your application, service your account, and satisfy legal, regulatory, tax, and recordkeeping requirements. When information is no longer needed, we delete or de-identify it. Retention periods vary depending on the type of information and the applicable legal requirements.

How we protect your information

We use administrative, technical, and physical safeguards designed to protect your information. Data is encrypted in transit and at rest, and access is restricted to authorized personnel and partners who need it to process your application. We review our practices regularly. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

How to opt out

You can control how we contact you and how we handle your information.

  • Text messages — reply STOP to any text message from us to stop receiving texts. Reply HELP for help.
  • Calls — tell the representative on the call, or contact us using the details below, and we will add your number to our do-not-call list.
  • Email — use the unsubscribe link in a marketing email, or contact us to opt out.
  • Access, correction, and deletion — you may request access to, correction of, or deletion of your personal information. We will respond as required by applicable law.

Opting out of marketing communications will not stop us from contacting you about an active application or account where we are permitted or required to do so.
