Terms of Service

These terms govern your use of clutchadvance.com and the IsoVana business platform, both operated by Clutch Advance Technologies LLC, a Texas limited liability company at 2915 S Zarzamora St, Bldg D, San Antonio, Texas 78225. By using the site or submitting an inquiry, you agree to these terms.

What we do, and what we do not do

Clutch Advance is a commercial finance brokerage. We gather information about your business, present it to third-party funders, and help you compare offers. We are not a lender, we do not make loans or advances, and we do not set the rates, factors, fees, or terms of any funding. Any funding agreement you sign is between you and the funder. The funder decides whether to fund, how much, and on what terms. Submitting an inquiry does not guarantee an offer, an approval, or a specific rate.

No fee to you for brokering

We are paid by the funder when a funding transaction closes. We do not charge you an application fee, a brokerage fee, or a consulting fee unless we disclose that fee to you in writing and you agree to it before it is charged.

Your responsibilities

You confirm that the information you give us is accurate and that you are authorized to submit it for the business. You agree to provide documents we request, including bank statements, tax returns, and identification, and to keep your contact information current. You agree not to submit information about a business you do not own or represent, not to use the site to break the law, not to attempt to access accounts or data that are not yours, and not to interfere with the site's operation.

IsoVana platform accounts

If you subscribe to the IsoVana platform, you are responsible for the activity under your account, for keeping your credentials confidential, and for the accuracy of the data you load. You agree to contact only people you are permitted to contact, to honor do-not-call and opt-out requests, and to comply with telemarketing, texting, and privacy law that applies to you, including obtaining any consent your outreach requires. Subscriptions are billed on a flat monthly basis as described at signup. Fees are stated before purchase, and we do not charge per lead or per referral.

Third-party funders and links

Funder offers, lender websites, and other third-party services are governed by those parties' own terms and privacy policies. We do not control them and are not responsible for their content, decisions, or conduct.

Intellectual property

The site, its text, design, and software, and the IsoVana platform are owned by Clutch Advance or its licensors and are protected by intellectual property law. You may use the site for its intended purpose. You may not copy, resell, or create derivative works from it without our written permission.

Disclaimers

The site and platform are provided "as is" and "as available." We do not warrant that the site will be uninterrupted or error free, that any funding will be approved, or that information on the site is complete or current. We are not providing legal, tax, accounting, or investment advice. Consult your own advisors.

Limitation of liability

To the maximum extent permitted by law, Clutch Advance is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising from the site or these terms will not exceed the greater of one hundred dollars or the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.

Indemnity

You agree to indemnify and hold Clutch Advance harmless from claims and costs, including reasonable attorneys' fees, arising from your use of the site, your breach of these terms, or information you submit that is false or that you were not authorized to submit.

Ending access

We may suspend or end your access to the site or the IsoVana platform if you violate these terms, if required by law, or if your account creates risk for us or others. You may stop using the service at any time. Sections on intellectual property, disclaimers, limitation of liability, indemnity, and governing law survive termination.

Governing law and venue

Texas law governs these terms, without regard to conflict-of-law rules. Disputes are brought in the state or federal courts located in Bexar County, Texas, and both parties consent to their jurisdiction. Before filing, you agree to send a written description of the dispute to lamar@clutchadvance.com and allow thirty days for resolution.

Changes

We may update these terms and will post the new effective date here. Continuing to use the site after a change means you accept the updated terms.
